Use Restrictions and Rules

Great Island operates under the Use Restrictions and Rules of both The Pinehills Landowners Association and the Great Island Homeowners Association. The Use Restrictions and Rules are incorporated into and part of the CC&R. If the Great Island Use Restrictions and Rules were to conflict with those of The Pinehills, the more restrictive rule would control.

Great Island

The CC&R (§4.2) allow the community to establish its own Use Restrictions and Rules. The following rules have been adopted by the Board of Directors;

Del Webb did not establish Initial Use Restrictions and Rules for Great Island. However, some elements of the Great Island Design Guidelines (such as the items listed below) could be considered Use Restrictions and Rules.  Here are some 'rules' taken from the Great Island Design Guidelines;

  • Holiday Lighting Rules
     
  • All portable play equipment, garden equipment (including hoses), and lawn furniture must be stored nightly within the Private Area and shall not be left on other portions of the lot so as to impede mowing and maintenance activities.
  • All trash containers shall be covered containers and shall be stored in the garage.
  • Trash containers may be left for collection at dusk on the day prior to collection and must be re-stored by dusk on the day of collection.
  • All barbecues must be located at least four feet (4') from any wall of the residence.
  • All outdoor fires must be natural gas or charcoal. Outdoor woodburning is prohibited except at approved events at the community center.
  • With a limited exception for a 'For Sale' sign, no signage is permitted on any residential lot.
  • Satellite dishes must not be visible from neighboring property or the street. However, Section 207 of the Telecommunications Act of 1996 effectively nullifies this rule.

    * Section 207 of the Telecommunications Act of 1996 prohibits HOA's rules that place restrictions on direct broadcast satellite dishes that are less than 39 inches (1 meter) in diameter. The rule prohibits most restrictions that:
    • unreasonably delay or prevent installation, maintenance or use, 
    • unreasonably increase the cost of installation, maintenance or use, or 
    • preclude reception of an acceptable quality signal.
