Creation of Late Charges for Past Due Assessment Payments
to the Pinehills Landowners Association

Under Section 8.8 of the Declaration of Covenants, Conditions and Restrictions for The Pinehills, the Board of Directors (the Board) may by resolution, determine late charges to be imposed on Owners/Members who fail to make timely payment of their Association Assessments. These late charges will apply in any instance in which a Owner/Member has not made a timely payment for their monthly Association Assessments, including Assessments due to the Pinehills Landowners Association, the Pinehills Private Sewer Treatment LLC and Assessments due to the Pinehills General Residential District Landowners Association, if applicable.

These late charges do not apply to Assessments due to a special residential district (eg. Forest Edge, Winslow's View, Great Island, Scion Highlands, Rebecca's Landing, etc.). Late charges will also not apply to any outstanding balance due to the Pinehills Water Company, which is a regulated public utility and which is required to follow the regulations of the Department of Public Utilities in addressing past due charges.

The late charges adopted by resolution of the Board of Directors are as follows:

For an invoice with an Assessment that is 30 days past due but less than 60 days past due: $5.00 For an invoice with an Assessment that is 60 days past due but less than 90 days past due: $20.00 For an invoice with an Assessment that is 90 or more days past due: $50.00

Late charges will be added to the total due from any Owner/Member and will appear on their monthly Pinehills LLC invoice and will be carried forward until such time as the past due balance is paid in full. Any payments received will apply first against any late charges that have been assessed and then against the actual assessment amount that is due or past due.

Additional late charges will be added each month to the total due from an Owner/Member until such time as the total amount that is past due, including any late charges that apply, has been paid in full.

For example:

If an Assessment is 30 days past due, the Owner/Member will receive a monthly invoice showing the new monthly Assessment due as well as the past due balance and a $5.00 late charge.

If no payments are received from the Owner prior to the issuance of the next monthly invoice, the invoice will reflect the new monthly Assessment due, as well as the balance that is past due. The invoice will also include a late charge of $20.00.

If no payments are received are received from the Owner prior to issuance of the next monthly invoice, the invoice will reflect the new monthly Assessment due as well as the balance that is past due. The invoice will also include a late charge of $50.00.

If prior to the next invoice being issued, the Owner pays their Assessments due in total, including all past due assessments and late charges, they will have paid $75 in total late charges.

Assessments that are greater than 120 days past due will be assessed a late charge of $50.00 and may be forwarded to a collection agency for handling and reported to a credit agency as a debt owed to the Association.

The Association will enter into payment plan arrangements with Owners/Members to address past due balances where circumstances warrant this consideration.
