Home owners in Great Island are subject to the Covenants, Conditions and Restrictions (CC&R) of both The Pinehills Landowners Association and the Great Island Homeowners Association.
The CC&R, also referred to as the 'Declaration', establish your rights and responsibilities as an owner. It is incorporated into the deed to your property and is legally binding.
- Covenants: Promises on the part of all members.
- Conditions: Conditions to membership in good standing.
- Restrictions: Restrictions on use of property (often called dead restrictions).
The Great Island Compliance Committee assists the Board of Directors in administering and enforcing the CC&R.
One way to think of the CC&R is as the 'master' document of the community. Everything else flows from this document. The CC&R creates the association (ARTICLE 5, Section 5.1) and establishes it's governance according to the 'governing documents' (by-laws).
The Great Island Covenants, Conditions and Restrictions are supplemental to those of The Pinehills and often referred to as the 'Supplemental Declaration'.
The Great Island Covenants, Conditions and Restrictions can be amended by a vote of 75% of the Great Island property owners (§8.2).
Amendments (None)
Here are some important provisions of the Great Island Covenants, Conditions and Restrictions;
- Altering, removing or otherwise destroying grasses or other vegetation, or the cutting, removing or otherwise destroying trees in the Undisturbed Open Space Area shall be permitted only with the approval of the Association, the District Association and, if required by applicable law, regulation or permit, the Planning Board of the Town of Plymouth. (§6.5)
- The Great Island Covenants, Conditions and Restrictions incorporate the;
- Great Island Use Restrictions and Rules (§4.2).
- Great Island Design Guidelines (§4.3).
DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR THE PINEHILLS (10/11/2000)
The Pinehills Covenants, Conditions and Restrictions are the master Covenants, Conditions and Restrictions. They can be amended by voting members representing 75% of the total owner votes of each voting group (§15.2). Great Island is a "District" of The Pinehills under The Pinehills Covenants, Conditions and Restrictions.
