By-Laws

The By-Laws establish the governance of the community, such as the term of the Board of Directors, elections and voting rights.

Great Island operates under the By-Laws of both The Pinehills Landowners Association and the Great Island Homeowners Association.


Great Island

Here is a summary of the Great Island By-Laws (please refer to the recorded by-laws for details). NOTE: Special rules apply during the Builder Control Period.

The By-Laws can be amended by a majority vote of the Board of Directors (§6.5b) or 75% of the owners (§6.5c). A special meeting will be called upon the signed petition of 35% of the owners(§2.4).

Amendments (None)

Under the community by-laws (§3.21), the association may sanction owners who fail to pay the association fee or violate any of the rules established in the community documents. These sanctions include fines, late fees, interest, suspension of member privileges and property liens.

The affairs of the association are goverend by the Board of Directors

  • The Board of Directors consists of between 3 and 5 residents elected by the owners (§3.1, 3.2).
  • The board officers includes, at a minimum, a President, Vice-President, Clerk and Treasurer (§4.1).
  • Any two or more offices may be held by the same person, except the offices of President and Clerk. (§4.1).
  • Directors serve staggered terms of two years which begin and end on the date of the annual meeting(§3.5).
  • Directors receive no compensation (§3.13).

Election

  • Elections are conducted by mail, prior to the annual meeting (§3.4).
  • The candidates receiving the greatest number of votes are elected (§3.4).
  • The board elects its officers from amongst its members immediately after each annual meeting (§4.2).

Duties

  • preparing an annual budget (§3.18a).
  • collecting general and special assessments (§3.18b).
  • enforcing the CCR, use restrictions and rules (§3.18h).
  • provide for recreational and social activities for owners (§3.18q).

Powers

The board's enforcement powers specifically include, but are not limited to;

  • The towing of vehicles that are in violation of parking rules (§3.21c).
  • Bringing suit at law or in equity to enjoin any violation (§3.21c).
  • To abate nuisances or to recover monetary damages or both (§3.21c).
  • The entry onto a Unit for purposes of exercising it's power (§3.21c).

Records

  • minutes must be kept for all Board of Directors meetings (§3.14).
  • all Board of Directors meetings are open to all owners (§3.15).

Board of Directors

  • The President of the Great Island Board of Directors serves as the district's voting member for the election of The Pinehills Board of Directors.
