Definitions

Chartered Clubs- Chartered Clubs are sponsored by the Great Island Homeowners' Association to provide an opportunity for all Association members to pursue common interests in hobbies, recreational, social and cultural endeavors.

Common Area - All of the property and facilities within The Pinehills (including Great Island) that are intended for the common use of residents. Common Area can be further designated as;

Limited Common Area - Parts of the Common Area are designated as Limited Common Area for the exclusive use of the residents of one district. The Common Area within Great Island (with the exception of the pond amenity) is designated as Limited Common Area.

Common Open Space - Some of the property within The Pinehills is subject to an open space covenant with the Town of Plymouth. The Common Open Space includes some of the Common Area and some of your lot. There are three types of Common Open Space;

General Access Common Open Space - Some of The Pinehills open space is accessible to the general public (such as the Village Green and the golf course).

Limited Access Common Open Space - The Pinehills designates the Common Open Space within Great Island as Limited Access Common Open Space for the exclusive use of Great Island residents.

Restricted Access Common Open Space - The Pinehills designates the Common Open Space in the front and rear of your lot as Restricted Access Common Open Space for your exclusive use.

Undisturbed Open Space - That part of the Common Open Space that has been left in its natural state. Undisturbed Open Space includes the rear portion of your lot as shown on your plot plan.

Why It's Not A Good Idea To Cut Down Trees in the Community Open Space.

Pinehills Standards - The standard of conduct, maintenance, or other activity generally prevailing throughout Pinehills, which shall, at a minimum, be a standard of good, clean, attractive and sanitary order, condition and repair, in compliance with law and not resulting in the cancellation of insurance or increase in insurance rates for insurance carried by the Association. (Pinehills CC&R, §2.32)

Private Area - That area of your lot inside of the building setbacks, defined as follows (G.I. Design Guidelines, § I.B & Appendix A §A);

  • five (5) feet (or three (3) feet if you have a chimney) from your side property lines,
  • twenty (20) feet from your front property line and
  • ten (10) feet from your rear property line .

    The Private Area also includes all portions of the lot within three (3) feet of the front service walk as originally installed by Del Webb, regardless of whether these areas are within the setback boundaries.

Supplemental Declaration - The Great Island Declaration of Covenants, Conditions and Restrictions, which are Supplemental to those of The Pinehills.

Artifact - "An object that is made, modified, altered, or transported by human agency or workmanship which cannot be confused with an accident of nature. [Indiana University] "

According to Appendix E of the Great Island Design Guidelines, an artifact shall include the following:

  1. Yard Decoration. Clay, masonry or metal objects (planters, pots and animals), wooden or metal barrels.
  2. Decorative Component. Small animal statue(s) that are either an integral part or adjunct to a fountain, waterfall, or birdbath.
  3. Decorative Landscape Feature. Waterfall or birdbath.

Charter - 1) A written document setting forth the governing principles of a group or organization * or 2) an authorization from a central organization to establish a local branch or chapter *.

Deed Restriction - Here is the text of the restriction placed on the deed to your property:

"The Property is conveyed subject to and with the benefit of all other covenants, easements, agreements and other matters of record, insofar as the same are now in force and applicable. It is intended that each and all of the covenants and agreements in this Deed to be performed by or on the part of Grantor or Grantee shall run with the land and shall be binding upon Grantor and Grantee and their respective legal representatives, successors and assigns."
